Website Terms of Use
Instrumento LLC
Effective date: August 19, 2026 · Version 2.3.0
1. Scope
These Website Terms of Use ("Website Terms") govern access to and use of Instrumento's public website at instrumento.io and its subdomains (the "Website"). They do not govern an organization's access to or use of the Instrumento software platform or professional services.
These Website Terms apply to everyone who visits the Website, including prospective customers evaluating Instrumento, existing customers browsing public pages, and anyone reading published materials such as sample reports.
2. Separate customer agreements
Access to the Instrumento platform and any paid, pilot, implementation, advisory, or professional services is available only under a separate written agreement executed by Instrumento and the applicable customer organization. That agreement, together with its order form and any applicable schedules — including a data processing addendum where personal data is processed — sets out the commercial and legal terms on which the platform is provided.
Instrumento does not offer self-service subscriptions and does not publish plan prices on the Website.
Descriptions of the platform, demonstrations, sample reports, illustrative figures, proposals, and communications made available through or in connection with the Website are informational. They do not constitute an offer, a guaranteed price, a service commitment, a service level, or a binding agreement, and they do not modify any agreement already in force.
Submitting a contact form, requesting a demonstration, requesting a sample report, or corresponding with Instrumento does not create a customer relationship and does not entitle anyone to access the platform.
If a signed customer agreement conflicts with these Website Terms, the signed customer agreement controls with respect to the subject matter it covers.
3. Business use only
The Website and the Instrumento platform are intended for organizations and for people acting in a professional capacity on an organization's behalf. They are not offered for personal, family, or household use.
If you submit a contact or demonstration request on behalf of an organization, you represent that the information you submit is accurate and that you are authorized to communicate on that organization's behalf.
Individuals under 18 years of age may not create accounts or submit sales requests through the Website.
This section concerns who may transact with Instrumento. It says nothing about the data a customer organization may process using the platform: customers may process participant, beneficiary, or programme data, including data relating to children, under the terms of their separately negotiated agreement and any applicable data processing addendum.
4. Permitted use of the Website
You may access and review the Website to evaluate Instrumento for your organization, to read published materials, and to contact us.
You may not:
- use the Website for any unlawful purpose or in violation of any applicable law or regulation;
- interfere with, disrupt, probe, or attempt to defeat the security or integrity of the Website or any system or network connected to it;
- use automated means to scrape, harvest, or extract Website content beyond ordinary indexing by publicly available search engines that respect our robots directives;
- attempt to access any non-public system, account, environment, or data, whether or not access succeeds;
- introduce malware or any other malicious or harmful code;
- impersonate any person or organization, or misrepresent your affiliation with one; or
- misuse Instrumento's trademarks, logos, or Website content, including by framing, mirroring, or presenting them as your own.
5. Intellectual property
Instrumento owns or licenses the Website and its contents, including the software behind it, its branding and trademarks, its design and layout, product descriptions, written materials, illustrations, and published sample materials.
You are granted a limited, revocable, non-exclusive, non-transferable right to access and review the Website for the legitimate purpose of evaluating Instrumento for your organization. No other right or licence is granted, whether by implication or otherwise.
These Website Terms do not address ownership of customer data, of AI outputs, or of reports and other materials generated through the platform. Those subjects are dealt with in the separately executed customer agreement, and nothing here assigns, licenses, or otherwise affects any right in them.
6. Information submitted through the Website is not confidential
Unless Instrumento has separately agreed in writing to treat it as confidential, or the parties have signed a non-disclosure agreement covering it, information you submit through a public contact form, demonstration request, or similar Website channel is not treated as confidential and creates no obligation of confidence.
Please do not submit sensitive information through public Website forms. In particular, do not submit beneficiary, participant, health, student, financial, or other sensitive personal data. If you need to share material of that kind as part of an evaluation, contact us and we will arrange an appropriate channel and, where required, the necessary agreements.
7. Privacy
How Instrumento handles personal information collected through the Website is described in the Privacy Notice at instrumento.io/legal/privacy, and the use of cookies and similar technologies is described in the Cookie Notice at instrumento.io/legal/cookies.
By using the Website you acknowledge the Privacy Notice. Acknowledgement is not consent to optional processing: consent for marketing communications, for non-essential cookies, and for any other optional processing is requested separately and may be withdrawn.
8. Third-party links and services
The Website links to and, in places, embeds services operated by third parties — for example scheduling tools such as Calendly. Those services are provided by their own operators under their own terms and privacy practices, and Instrumento does not control them. Following such a link or using such a service is a matter between you and the operator concerned. The presence of a link is not an endorsement.
9. Informational content
Website content — including product descriptions, sample reports, worked examples, calculations, SROI illustrations, AI demonstrations, and impact figures shown for illustration — is provided for information. Sample and demonstration material does not describe any particular organization's actual results.
None of it is legal, accounting, tax, investment, grant-making, or professional evaluation advice, and it should not be relied on as a substitute for advice from a qualified adviser who knows your circumstances.
Instrumento does not guarantee that use of the Website or of any material published on it will result in funding, in particular programme outcomes, in regulatory compliance, or in any other specific result.
10. Website availability
Instrumento may change, update, suspend, or discontinue any part of the Website, including its content and features, at any time and without notice.
This section applies to the public Website only. Availability of contracted platform services is governed by the applicable customer agreement and not by this section.
11. Disclaimers and limitation of liability
The Website is provided "as is" and "as available". To the maximum extent permitted by applicable law, Instrumento disclaims all warranties with respect to the Website, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Website will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, Instrumento will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Website. Instrumento's total cumulative liability arising out of or related to the Website will not exceed one hundred US dollars (USD $100).
This section limits liability for use of the public Website. It does not replace, reduce, or otherwise affect the warranties, indemnities, or liability terms agreed in a signed customer agreement, which govern the platform and any services provided under it.
Nothing in these Website Terms excludes or limits liability that cannot lawfully be excluded or limited.
12. Changes to these Website Terms
Instrumento may update these Website Terms by publishing a revised version on the Website with a new version number and effective date. Changes take effect when published, and they apply to use of the Website from that date.
Publishing a revised version of these Website Terms does not amend any separately signed customer agreement. An agreement of that kind is changed only as that agreement itself provides.
13. Governing law
These Website Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law principles. Governing law, jurisdiction, and dispute resolution for the platform and for services are set out in the applicable customer agreement.
14. General
If any provision of these Website Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. A failure to enforce a provision is not a waiver of the right to enforce it later.
